We Charter Policies

​Operation Policy 

1. Charter Timing:

  • The charter period begins the moment the captain steps onto the boat and ends when the boat is turned off at the dock or the last passenger has disembarked, whichever occurs last.

  • Time spent boarding and unboarding at the dock is considered part of the chartered time.

2. Prohibited Substances and Behavior:

  • No recreational drugs of any kind are permitted on the boat.

  • If the captain observes any drugs on board, they are required to report the incident, return to the dock immediately, and terminate the charter with no refund.

  • No smoking is allowed inside the boat. Smoking is permitted on deck only.

3. Alcohol Consumption:

  • Drinking is allowed; however, any behavior that becomes difficult to manage, does not comply with the captain's guidelines, or leads to illness will result in the captain returning to the dock and ending the charter without a refund.

4. Age Restrictions:

  • No children under the age of 12 are permitted on the boat.

  • A maximum of 2 individuals between the ages of 12 and 21 are allowed per charter.

5. Cancellation Policy:

  • Full refunds are provided for cancellations made at least 7 days (one week) in advance.

  • Cancellations made between 7 days and 72 hours before the scheduled charter will receive a 50% refund.

  • No refunds will be provided for cancellations made less than 72 hours before the scheduled charter.

6. Compliance and Safety:

  • All passengers are expected to follow the captain's instructions at all times. Failure to comply may result in the termination of the charter without a refund.

  • The captain retains full legal authority while on the water.

  • The captain works for the charterer, not for the boat's owner, as is standard in all bareboat charters, and is paid by the charter, either directly or indirectly.

  • The charterer is solely responsible for the safety of passengers and the vessel.

  • The captain is obligated to follow all legal requirements and the boat manufacturer's limits and guidelines.

  • The captain cannot follow the charterer's directives if they conflict with the law or the boat manufacturer's guidelines.

  • No toilet paper is to be flushed down the toilet. All paper and trash must be disposed of in the provided trash bins.

  • No pets are allowed on the boat.

  • No passenger is allowed to jump off the boat unless the boat is anchored, the engines are off, and the captain has given permission for a recreational swim.

  • When the captain instructs swimmers to return to the boat, they must comply immediately. Failure to do so will obligate the captain to report a man overboard to the U.S. Coast Guard or the relevant local authorities.

  • Any damage to the vessel caused by passengers will be the financial responsibility of the charterer.

  • Passengers acknowledge the inherent risks associated with boating and agree to release WeCharter.net and its staff from liability for personal injuries.

  • Charterers may bring their own recreational equipment (e.g., floating noodles, fins, masks, paddle boards), but all items must be approved by the captain prior to boarding for safety reasons.

7. Weather and Sailing Conditions:

  • The charter operates rain or shine.

  • The captain will not take the boat into the open ocean if waves exceed 2 feet and there are more than 5 passengers on board.

  • For sport sailing trips, open ocean sailing is allowed if there are fewer than 5 passengers and waves are less than 4 feet high.

  • In the event of severe weather or other emergencies, the captain has full authority to alter the route or return to the dock for safety reasons.

8. Additional Policies:

  • Passengers are allowed to bring their own food and drinks, but no glass containers are permitted.

  • A gratuity of 20% of the cost of the charter is expected for the captain and crew.

  • Late arrivals will not extend the charter time. No-shows will forfeit their payment.

  • Photos taken by the crew during the charter may be used for promotional purposes unless passengers request otherwise.
