WE CHARTER
Bareboat Charter Policies
1. Nature of Charter
All vessels are provided exclusively under a Bareboat (Demise) Charter Agreement.
Under this structure:
-
The Charterer rents the vessel only.
-
The Charterer assumes possession and operational control of the vessel for the duration of the charter.
-
If the Charterer does not operate the vessel personally, they must independently hire a qualified captain.
-
Any hired captain works directly for the Charterer.
We Charter does not provide crew, operate the vessel, or control navigation.
We Charter does not provide transportation services. The vessel is rented as a private recreational bareboat charter. The Charterer determines the itinerary and assumes responsibility for the voyage.
2. Charter Timing
The charter period begins at the scheduled departure time and ends at the agreed return time.
Boarding and disembarking occur within the reserved charter window.
Late arrivals do not extend charter time.
No-shows forfeit payment.
3. Conduct and Prohibited Substances
-
No illegal drugs are permitted onboard.
-
If illegal substances are observed, the hired captain may immediately terminate the voyage without refund.
-
Smoking is not permitted inside the vessel.
-
No glass containers.
-
No pets without prior approval.
Alcohol is permitted; however, unsafe or disruptive behavior may result in early termination of the charter at the captain’s discretion.
4. Safety and Authority
The hired captain retains navigational authority and is responsible for safety decisions while underway.
The captain may alter the route, restrict swimming, or return to dock if deemed necessary for safety.
The Charterer assumes responsibility for all guests onboard and for compliance with all federal, state, and local laws, including passenger capacity limits.
Maximum capacity: 12 guests plus the Charterer, in accordance with bareboat charter regulations.
5. Swimming and Water Activities
Passengers may enter the water only when:
-
The vessel is safely positioned,
-
Engines are off, and
-
The captain authorizes entry.
All swimmers must comply immediately with recall instructions.
6. Weather Policy
Charters operate rain or shine.
If severe weather conditions make navigation unsafe, the hired captain will determine whether to modify or cancel the voyage.
Booking deposits are non-refundable but may be applied as credit toward a future charter if:
-
The forecast shows 50% or greater probability of rain for at least half the charter window, or
-
Written notice is provided at least 1 days (24 hs) prior to the scheduled charter.
Credits may be applied toward a future available date.
7. Damage and Responsibility
The Charterer assumes responsibility for the vessel during the charter period.
Any damage caused by guests will be charged to the Charterer.
Boating involves inherent risks. By chartering, the Charterer and guests acknowledge and accept those risks.
8. Gratuity
Gratuity for hired captains is customary and entirely at the discretion of the Charterer.
