This Agreement is made between the undersigned Client,
Madison Keirsey
and the undersigned Captain,
James Ballew
for charter captain services aboard the Vessel described below.
1. Scope of Services
The Captain agrees to operate and safely navigate the Vessel on behalf of the Guest for the agreed charter period.
The Captain shall be responsible for the overall. safety and operation of the Vessel. The captain is the authority on the water.

3 Charter Period:
The charter period begins at the scheduled start time and ends upon the vessel’s return to the designated home dock, regardless of passenger boarding time or vessel departure status. Time is measured dock-to-dock. Requests for alternate pickup or drop-off locations do not alter the time calculation.

4. Captain Responsibilities
a. Safe Operation:
The Captain shall have full authority over the safe operation of the vessel, including compliance with all maritime laws and the right to make decisions in the interest of safety, especially in emergencies.
b. Enforcement of Charter Rules:
The Captain is responsible for enforcing the following rules during the charter:
b1. Passenger Limit: A maximum of 12 passengers is allowed onboard at any time.
b2. Prohibited Conduct: No illegal substances or unlawful behavior is permitted.
b3. No Fishing: Fishing is not allowed during the charter.
b4. No Smoking: Smoking is strictly prohibited onboard.
b5. No Trampoline/Webbing Use: Jumping on trampolines or webbings is not allowed.
b6. No Unsafe Movement: Passengers may not leave the vessel or move about when the boat is in motion or the engines are running.
c. Legal Compliance and Reporting:
The Captain shall ensure that all onboard activities comply with U.S. Coast Guard and applicable local laws. If any of the above rules are violated, the Captain has the authority to terminate the charter, return to port or dock, and report the incident to the relevant authorities.
5. Payment Terms
The total captain fee for the charter is $

Payment Due: Full payment is due before the begining of the charter period unless otherwise agreed in writing
Gratuities: Gratuities for the crew members are not included in the charter fee. While not mandatory, they are expected by the crew for good service and typically range from 15–25% of the charter cost.
6. Indemnification & Liability
a. Indemnification: Each party shall hold the other harmless from any claims or damages resulting from this Agreement, except in cases of gross negligence or willful misconduct.
7. Governing Law
This Agreement shall be governed by the laws of the State of Florida. Any disputes shall be resolved in Florida courts.
8. Entire Agreement
This document represents the full understanding between the parties and supersedes any prior discussions or agreements.
